DECISION & ORDER ON APPLICATION

The petitioners in the following named causes having taken appeals, and the parties having agreed to enlarge the time of the petitioners to perfect their respective appeals until the determination of certain related appeals in matters entitled Hedgepeth v Wing (Appellate Division Docket Nos. 2004-08723 and 2005-02665), Moore v Wing (Appellate Division Docket No. 2005-02666); Mullin v Wing (Appellate Division Docket No. 2005-02652), and Gioia v Wing (Appellate Division Docket No. 2005-02661). By decision and order on motion of this court dated February 10, 2006, entitled "In the Matter of Dismissal of Causes for Failure to Perfect - January 2006 Calendar", the appeals in the following named causes were dismissed for failure to perfect.

Now, on the court's own motion, it is

ORDERED that so much of the decision and order on motion dated February 10, 2006, as dismissed the following appeals is recalled and vacated, and the appeals are reinstated; and it is further,

ORDERED that pursuant to 22 NYCRR 670.8(d)(2), it is
