| DECISION & ORDER ON MOTION |
Motion by counsel assigned to represent the defendant in the County Court, Westchester County, to be relieved of the assignment to respond to an appeal by the People from an order of that court, entered July 1, 2005.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that counsel is directed to turn over all papers in the action to new counsel herein assigned; and it is further,
ORDERED that Jeanne E. Mettler, of 17 Adams Street, Bedford Hills, New York 10537, is assigned as attorney for the defendant pursuant to County Law § 722 to respond to the appeal from said order; and it is further,
ORDERED that the respondent is directed to serve one copy of his brief and to file nine copies thereof; and it is further,
ORDERED that on the court's own motion, the respondent's time to serve and file a brief is enlarged until June 7, 2006, and the respondent's brief shall be served and filed on or before that date.
