DECISION & ORDER ON MOTION

Motion by the appellant for leave to appeal to this court from an order of the Supreme Court, Suffolk County, dated December 13, 2005, and to consolidate that appeal with an appeal from an order of the Family Court, Suffolk County, dated October 5, 2005.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the order dated December 13, 2005, is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the motion is otherwise denied.
