Motion by the petitioner, inter alia, for leave to reargue the prior motions of the respondents to dismiss this proceeding, which motions were determined by decision, order, and judgment of this court dated December 12, 2005.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the petitioner's motion which is for leave to reargue is granted, and, upon reargument, the decision, order, and judgment of this court dated December 12, 2005, in the above-entitled proceeding is recalled and vacated, and the respondents' motions are denied; and it is further,
ORDERED that the petitioner's motion is otherwise denied; and it is further,
ORDERED that the time within which the respondents may serve their respective answers to the petition, with supporting affidavits, if any, is extended until 15 days after service upon them of a copy of this decision and order on motion.
