| DECISION & ORDER ON MOTION |
Motion by Gregory Tarone, inter alia, for leave to reargue an appeal from an order of the Supreme Court, Suffolk County, dated January 9, 2004, which was determined by decision and order of this court dated January 31, 2006, and for an award of an attorney's fee and cross motion by Madeleine Tarone, inter alia, for an award of an attorney's fee.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied with $100 costs; and it is further,
ORDERED that the branch of the cross motion which is for an award of costs is granted to the extent indicated; and it is further,
ORDERED that the cross motion is otherwise denied.
