Motion by the petitioner in a proceeding pursuant to CPLR article 78, which was transferred to this court by order of the Supreme Court, Westchester County, entered October 25, 2005, to remit the proceeding to the Supreme Court, Westchester County.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and the proceeding is remitted to the Supreme Court, Westchester County (see Matter of Halperin v City of New Rochelle, 24AD3d 768).
