Ordered that the motion to vacate the dismissal is granted. The dismissal order of the Appellate Term, dated 18th day of August 2003, is hereby vacated. The appeal is re-instated and the appellant is directed to perfect the appeal by no later than the December 2006 term. That branch of the motion seeking leave to appeal as a poor person is granted.
