It is Ordered that the motion seeking permission to deposit funds with the Clerk of the New York County Civil Court is denied. The cross-motion seeking to vacate the stay is denied, without prejudice to renew in the event the appellant fails to tender $41,164.58 to the petitioner-landlord, without prejudice, by May 1, 2006. If the appellant fails to comply with the orders of this Court, the petitioner-respondent may move on five days' notice for an order vacating the stay. [ cal # 06-189 - June 2006 term ]
