Motion by the appellant-respondent for leave to reargue an appeal and cross appeal from an order of the Supreme Court, Queens County (Satterfield, J.), dated January 3, 2005, which were determined by decision and order of this court dated January 31, 2006, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court, and cross motion by the respondent-appellant for the same relief.

ORDERED that the motion and cross motion are denied.
