It is Ordered that the motion is granted to the extent of continuing the stay and enlarging the time to perfect the appeal by no later than June 28, 2006 and noticed for the September 2006 term. The arrears outstanding through May 2006 are to be tendered to the petitioner-landlord by May 12, 2006, without prejudice. In the event of appellant's failure to comply with the orders of this Court, petitioner may move on five days' notice for an order vacating the stay. The papers submitted as a cross-motion , not having been timely served, were considered solely in opposition to the motion. [CPLR § 2215].
