Motion by the defendant for leave to appeal to this court from an order of the Supreme Court, Nassau County, dated November 22, 2004, and to stay enforcement of the order pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied without prejudice to appealing from any final judgment entered in the action; and it is further,
