DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the Supreme Court, Kings County, rendered September 9, 1999. By order to show cause dated March 30, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned.

On the court's own motion, and no papers having been filed in opposition to the order to show cause, it is

ORDERED that the appeal is dismissed.
