Motion by the respondent to dismiss an appeal from a judgment of the Civil Court, City of Yonkers, rendered January 5, 2006, upon the ground that the Appellate Division, Second Department lacks subject matter jurisdiction.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
