DECISION & ORDER ON MOTION

Appeal by Vincent R. Scafidi from an order of the Family Court, Westchester County, dated September 20, 2005. By scheduling order dated February 1, 2006, the appellant was given until April 3, 2006, to perfect the above-entitled appeal. The appeal has not been perfected. By order to show cause dated April 13, 2006, the parties or their attorneys were directed to show cause why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding.

Now, on the court's own motion, and no papers having been filed in opposition or relation thereto, it is

ORDERED that the appeal is dismissed, without costs or disbursements.
