DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from a judgment of the County Court, Nassau County, rendered February 25, 2004, on the ground that it is abandoned.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied on condition that on or before June 9, 2006, the appellant either (a) retains an attorney and advises the court of his name or (b) moves for poor person relief and the assignment of counsel.
