| DECISION & ORDER ON MOTION |
Motion by the appellant to stay distribution of $40,000 of the first $50,000 of the proceeds of the sale of the subject premises pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, dated March 10, 2006.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and distribution of $40,000 of the first $50,000 of the proceeds of the sale of the subject premises is stayed pending hearing and resolution of the appeal.
