DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the County Court, Orange County, rendered May 13, 1999. By order to show cause dated April 7, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned.

Now, upon the court's own motion, and no papers having been filed in response to the order to show cause, it is

ORDERED that the appeal is dismissed as abandoned (see 22 NYCRR 670.8[f]).
