Motion by the appellant pro se on an appeal from an order of the Supreme Court, Queens County, dated January 30, 2006, inter alia, for leave to prosecute the appeal as a poor person, and to waive the filing fee for the instant motion pursuant to CPLR 8022 and 22 NYCRR 670.22(a)(2).
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branch of the motion which is to waive the filing fee for the instant motion is granted; and it is further,
ORDERED that the motion is otherwise denied.
