| DECISION & ORDER ON MOTION |
By decision and order dated March 17, 2006, the court accepted the voluntary resignation of Irving K. Schwartz and removed his name from the roll of attorneys and counselors-at-law in the State of New York, without prejudice to an application for reinstatement. Mr. Schwartz was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 22, 1949.
On the court's own motion, it is
ORDERED that the decision and order of this court dated March 17, 2006, in the above-entitled matter is recalled and vacated; and it is further,
ORDERED that the proffered resignation is dismissed as academic in view of the death of Irving K. Schwartz, in August 2005.
