Motion by the appellants-respondents for leave to reargue an appeal from a judgment of the Supreme Court, Nassau County, entered August 2, 2004, which was determined by decision and order of this court dated December 12, 2005, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Cross motion by the respondent-appellant for leave to appeal to the Court of Appeals from the same decision and order.
Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is denied.
