| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an amended order of the Supreme Court, Nassau County, dated May 3, 2006, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the notice of appeal is treated as an application for leave to appeal, and leave to appeal is granted (see CPLR 5701[a][2];[c]); and it is further,
ORDERED that the motion is granted and enforcement of the order dated May 3, 2006, is stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before June 23, 2006; and it is further,
ORDERED that in the event the appeal is not perfected on or before June 23, 2006, the court, on its own motion may vacate the stay, or th respondent may move to vacate the stay, on three days notice.
