| DECISION & ORDER ON MOTION |
Appeal by the defendant from a judgment of the County Court, Nassau County, rendered September 24, 1997. By order to show cause dated April 27, 2006, the appellant was directed to show cause before this court why an order should or should not be entered dismissing the appeal in the above-entitled action on the ground that he has abandoned the appeal.
On the court's own motion, and the papers filed in opposition to the order to show cause, it is
ORDERED that the appeal is dismissed (see NYCRR 670.8[f]; CPL 470.60[1]).
