| DECISION & ORDER ON MOTION |
Appeal by the defendant from a judgment of the County Court, Orange County, rendered April 20, 1994. By order to show cause dated April 27, 2006, the appellant was directed to show cause why an order should or should not be entered dismissing the appeal as abandoned.
On the court's own motion, and no papers having been filed in response to the order to show cause, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the appeal is dismissed as abandoned (see 22 NYCRR 670.8[f]; CPL 470.60[1]).
