It is Ordered that the motion for a stay is granted, without opposition, on the condition that appellant perfects the appeal by the October 2006 term of this Court - the filing date for which is August 8, 2006. Accruing use and occupancy is to be tendered to the petitioner, without prejudice. In the event of appellant's failure to comply with the order of this Court, petitioner may move on five days' notice for an order vacating the stay. The appeal may proceed on the original record of the trial court and type-written briefs.
