It is Ordered that the motion for an order "staying" the summary judgment order of the trial court that dismissed the hold-over petition is denied. The cross-motion to dismiss is granted unless the appeal is perfected by no later than the October 2006 term - the filing deadline is August 8, 2006. In the event of appellant's failure to comply with the foregoing condition, respondent may move on five days' notice for an order dismissing the appeal.
