ORDERED that the order on application of this court dated May 18, 2006, in the above-entitled case is recalled and vacated and the following order on application is substituted therefor:
Application by the appellants to withdraw an appeal from an order of the Supreme Court, Suffolk County, entered October 31, 2005, insofar as asserted against the respondents Alcatel Internetworking, Inc., Christie, Parker & Hale, LLP, and Brian K. Brookley.
