It is Ordered that the motion insofar as it seeks to vacate the stay pending the appeal is denied as moot. By order of this Court, dated May 22, 2006, this Court affirmed the trial court's judgment. Accordingly, the conditional stay continues for five (5) days after service of a copy of the order of affirmance on the appellant's attorney, with notice of its entry. (see CPLR § 5519[e]) In all other respects, the motion is denied, without prejudice.
