ORDER ON APPLICATION

Separate applications by the respondents International Business Machines Corp. and Grubb & Ellis Management Company pursuant to 22 NYCRR 670.8(d)(2) to enlarge their time to serve and file their respective briefs on an appeal from a judgment of the Supreme Court, Westchester County, dated August 5, 2005.

ORDERED that the applications are granted; and it is further,

ORDERED that the time of the respondent International Business Machines Corp. to serve and file a brief is enlarged until June 16, 2006, and the brief of the respondent International Business Machines Corp. must be served and filed on or before that date; and it is further,

ORDERED that the application is granted and the brief of the respondent Grubb & Ellis Management Company which was submitted to the Clerk of this court on May 30, 2006, is accepted for filing; and it is further,

ORDERED that the appellant's reply brief, if any, shall be served and filed on or before July 3, 2006.
