DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from an order of the Family Court, Nassau County, dated February 27, 2006, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the court's own motion, the appellant's notice of appeal is treated as an application for leave to appeal to this court, and leave to appeal is granted (see CPLR 5701[c]; Family Ct Act § 1112); and it is further,

ORDERED that the motion is granted; and it is further,

ORDERED that the Law Guardian, Renee G. Mayer, 7 Leeds Drive, Port Washington, New York, 11050, is directed to turn over all papers in the action to the new Law Guardian herein assigned; and it is further,

ORDERED that pursuant to Family Court Act § 1120, the following named attorney is assigned as Law Guardian to represent the appellant:
