DECISION & ORDER ON MOTION

Motion by the appellant pro se, inter alia, for leave to reargue an appeal from a judgment of the Supreme Court, Westchester County, dated January 28, 2004, which was determined by decision and order of this court dated April 4, 2006, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee pursuant to CPLR 8022(b) is granted; and it is further,

ORDERED that the motion is otherwise denied.
