It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. The Commissioner of Finance of the City of New York is directed to release the sum of four thousand five hundred seventy-one dollars and sixty seven cents ($4,571.67), representing three months of unpaid use and occupancy [ December 2005 to February 2006] to the Petitioner-Landlord 21 West 58th Street Corp. The remaining balance on deposit, plus interest and less any Department of Finance costs, is to be released by the Commissioner of Finance to the Respondent-Appellant Carol Pilosi.
