DECISION & ORDER ON MOTION

Motion by the appellant (1) for leave to appeal to the Court of Appeals from a decision and order of this court, dated April 25, 2006, which determined an appeal from an order of the Family Court, Queens County, dated August 29, 2005, and (2), in effect, to continue the assignment of Dawn Shammas, Esq. as counsel for the appellant for the purpose of making this motion and prosecuting any appeal before the Court of Appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the branch of the motion which is, in effect, to continue the assignment of Dawn Shammas, Esq. as counsel for the appellant for the purpose of making this motion is denied as unnecessary (see Family Ct Act § 1120[1]); and it is further,

ORDERED that the branch of the motion which is to continue the assignment for the purpose of prosecuting the appeal before the Court of Appeals is denied as academic.
