DECISION
On the court's own motion, motion by respondent Greenpoint Savings Bank (Greenpoint) to dismiss the appeal or, in the alternative, enlarge time to file a respondent's brief, and motion by respondent Chicago Title Insurance Company s/h/a Ticor Title Co. (Chicago Title Co.) to enlarge time to file a respondent's brief consolidated for purposes of disposition.
That branch of the motion by respondent Greenpoint seeking dismissal of the appeal from an order and judgment entered April 4, 2005 is withdrawn.
That branch of the motion by respondent Greenpoint seeking dismissal of the appeal from an order entered August 24, 2005 denied as academic, as the record does not reflect that appeal was taken from said order.
Those branches of the motions by respondents seeking enlargement of time to file respondent's briefs are granted, and said briefs shall be served and filed within 21 days from the date of the order hereon.
Appellant, if he be so advised, may serve and file a reply brief within 14 days after the filing of the respondents' briefs.
