| DECISION & ORDER ON MOTION |
Motion by the appellants Mitchell Hill and Central Queens Property Corp. to stay all proceedings, including the trial, in the above-entitled action pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, dated November 9, 2001 (Appellate Division Docket No. 2002-00161), and to consolidate the appeal with an appeal from an order of the same court dated August 1, 2005 (Appellate Division Docket No. 2005-08152).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is to stay all proceedings, including the trial, in the above-entitled action is denied; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,
ORDERED that on the court's own motion, the appeals shall be calendared together, and shall be argued or submitted on the same day.
