| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Family Court, Queens County, dated July 14, 2005, on the ground that it has been rendered academic. Separate motion by the appellant for leave to prosecute the appeal as a poor person, for the assignment of counsel, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motions, the papers filed in relation to the motion to dismiss, and no papers having been filed in opposition or relation to the motion, inter alia, for leave to prosecute the appeal as a poor person, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion, inter alia, for leave to prosecute the appeal as a poor person is denied as academic.
