DECISION & ORDER ON MOTION

Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Nassau County, dated May 16, 2006, on the ground that the appeal has been rendered academic.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and the appeal is dismissed as academic, without costs or disbursements; and it is further,

ORDERED that the stay granted by decision and order on motion of this court dated June 6, 2006, is vacated forthwith.
