It is Ordered that the motion and cross-motion are consolidated for disposition. The execution of the warrant of eviction is stayed, to and including, September 13, 2006. If, by said date, the appeal has been perfected from an order of the Civil Court, dated October 3, 2005, and the appellant is current in the payment of use and occupancy, then appellant may move for a continuation of the stay. Otherwise, the warrant of eviction may be enforced after September 13, 2006.
