1725 York Venture v Block, Michael, et al.

It is Ordered that the motion is granted only to the extent of staying the execution of the warrant of eviction on condition that the appellants: 1- remove the dog from the premises within five days of service of a copy of this order; 2- continue to pay for accruing use and occupancy on each subsequent rental due date; and3- perfect the appeal by the October 2006 term - the filing deadline is August 8, 2006. In the event of appellants' failure to comply with the foregoing conditions, petitioner may move on five days notice for an order vacating the stay of the execution of the warrant of eviction. In all other respects, the motion is denied.
