It is ordered that the motion is granted to the extent of permitting defendant to file an untimely notice of appeal. The Bronx County Appeal's Clerk is directed to file a notice of appeal on behalf of the defendant within 30 days of this order. That branch of the motion seeking permission to appeal as a poor person and the assignment of counsel is denied without prejudice to renew upon completion of the application form to appeal as a poor person.
