DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the Supreme Court, Queens County, entered January 5, 2006. By order to show cause dated May 16, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal as abandoned.

On the court's own motion, and no papers having been filed in response to the order to show cause, it is

ORDERED that the appeal is dismissed as abandoned, without costs or disbursements.
