| DECISION & ORDER ON MOTION |
Motion by the Grievance Committee for the Second and Eleventh Judicial Districts for an order suspending the respondent for an indefinite period and until the further order of this court on the ground that he is incapacitated from continuing to practice law, pursuant to 22 NYCRR 691.13(b), and appointing an attorney or attorneys to inventory respondent's files, pursuant to 22 NYCRR 691.13(d), to take such action as the court deems proper and advisable to protect the interests of respondent's clients and for the protection of respondent's interests, as well. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 14, 1987, under the name Alan Mark Rocoff.
Upon the papers submitted in support of the motion and the papers submitted in response thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the respondent is suspended on the grounds of medical incapacity pursuant to 22 NYCRR 691.13(b)(1), for an indefinite period of time and until further order of this court, based upon the reports of the respondent's treating doctors dated April 3, 2005, and March 22, 2006; and it is further,
ORDERED that Catherine Sammartino, Esq., 67 The Helm, East Islip, N.Y. 11730, is appointed conservator pursuant to 22 NYCRR 691.13(d), to inventory the respondent's files and to take such action as is deemed properly advisable to protect the interests of the respondent's clients and the interests of respondent, as well; and it is further,
ORDERED that if the respondent, Alan M. Rocoff, admitted as Alan Mark Rocoff, has been issued a secure pass by the Office of Court Administration, it shall be returned forthwith to the issuing agency, and the respondent shall certify to the same in his affidavit of compliance pursuant to 22 NYCRR 691.10(f).
