Appeal by the defendant from a judgment of the County Court, Suffolk County, rendered October 29, 2001.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed on the ground that this appeal is a duplicate of an appeal pending under Appellate Division Docket No. 2001-10012, under Indictment No. 1932/01, which was determined by decision and order of this court dated November 29, 2004. Indictment No. 2077/00 was superseded by Indictment No. 1932/01.
