On the court's own motion, it is
ORDERED that the decision and order on motion of this court, dated May 3, 2006, which granted the appellant's pro se motion for leave to serve and file a replacement supplemental brief on an appeal from a judgment of the County Court, Suffolk County, rendered July 1, 2003, is recalled and vacated; and it is further,
ORDERED that the appellant's motion for leave to file a replacement supplemental brief is denied.
The appellant has failed to file a replacement supplemental brief although afforded sufficient opportunity to do so.
SCHMIDT, J.P., SPOLZINO, FISHER and LIFSON, JJ., concur.
