| DECISION & ORDER ON MOTION |
Motion by the appellant-respondent to enlarge the time to perfect an appeal from a a judgment of the Supreme Court, Westchester County, dated September 1, 2005, and to dismiss the cross appeal from the order on the ground that it was not timely taken.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the appellant-respondent's time to perfect the appeal is enlarged until August 22, 2006, and the record or appendix on the appeal and the appellant-respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the cross appeal is dismissed, without costs or disbursements (see CPLR 5513).
