Motion by FC Yonkers Associates, LLC, and FC Yonkers Commercial, LLC, for leave to intervene on an appeal from an order and judgment (one paper) of the Supreme Court, Westchester County, dated May 2, 2006, or, in the alternative, for leave to serve and file an amicus curiae brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for leave to intervene is denied; and it is further,
ORDERED that the branch of the motion which is for leave to serve and file an amicus curiae brief is denied with leave to renew when the appeal is perfected.
