| DECISION & ORDER ON MOTION |
Motion by the appellants Interfaith Medical Center, Cheryl Barbara Ollivier, and Lauren Renee Browne, s/h/a "John" Brown, to stay all proceedings in the above entitled action, including the trial thereof, pending hearing and determination of appeals from an order of the Supreme Court, Kings County, dated May 23, 2006. Separate motion by the appellant Jean-Baptiste Simeon for the same relief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion the appeals are dismissed, without costs or disbursements, as no appeal lies from an order which determines a motion in limine (see Winograd v Price, 21 AD3d 956); and it is further,
ORDERED that the motions are denied as academic.
