| DECISION & ORDER ON MOTION |
Motion by retained counsel, to be withdraw as counsel for the appellant on an appeal from a judgment of the Supreme Court, Kings County, rendered November 15, 1998, on the ground that the appellant has abandoned the appeal. By order to show cause dated June 19, 2006, the appellant was directed to show cause before this court, why an order should or should not be entered dismissing the appeal as abandoned (see 22 NYCRR 670.8[f]), and the motion by counsel to withdraw was held in abeyance in the interim.
On the court's own motion and no papers having been filed in opposition to the motion by counsel to withdraw or in opposition to the order to show cause, it is
ORDERED that the appeal is dismissed (see CPL 460.70[2][c]; 22 NYCRR 670.8[f]; and it is further,
ORDERED that the motion by counsel to withdraw as counsel on the appeal is granted.
