It is Ordered that the motion by landlord-appellant to compel the respondents to tender use and occupancy to the landlord pending the determination of their appeal is denied. The appeal was decided by order of this Court, dated July 21, 2006, whereby the dismissal order of the Civil Court was affirmed.
