| DECISION & ORDER ON APPLICATION |
Application by the respondent to enlarge the time to comply with a decision and order on motion of this court dated July 7, 2006, in the above-entitled case, which directed it file with the Clerk of this court the record of any proceedings which occurred in connection the action entitled People v Smith, pending under Indictment No. 03-00287, and to file its brief on or before August 7, 2006.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the respondent's time to comply with the decision and order on motion dated July 7, 2006, is enlarged until October 6, 2006, and the respondent shall file with the Clerk of this court the record of any proceedings which occurred in connection the action entitled People v Smith, pending under Indictment No. 03-00287, and its brief on or before that date.
