DECISION & ORDER ON MOTION

Motion by the respondent for leave to appeal to the Court of Appeals from a decision and order of this court dated April 25, 2006, which determined an appeal from an order of the Family Court, Queens County, dated August 10, 2005, and to stay all proceedings in the Family Court, Queens County, in the above-entitled proceeding pending hearing and determination of the appeal to the Court of Appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
